Unconscionable EULA terms seem to be getting noticed as of late. I figured I’d do my own part to help with the effort:
“Neither party shall (i) create, publish, distribute or permit any written material which makes reference to the other party hereto without first submitting such material to the other party and receiving the prior written consent of such party, which consent shall not be unreasonably withheld or delayed, nor (ii) disclose to the public or any third party the relationship between them or the transactions contemplated by this Agreement without receiving the prior written consent of the other party, which consent shall not be unreasonably withheld or delayed. THE AFFILIATE PARTNER IS PROHIBITED FROM ISSUING A PRESS RELEASE DESCRIBING THE RELATIONSHIP OR THE TERMS OF THIS AGREEMENT WITHOUT BARNES & NOBLE.COM’S PRIOR APPROVAL.”
Wow. There are other such statements in there too. In other words, by displaying BN advertisements, they get editorial control over your content if it mentions BN. This is not a good thing. I really don’t like it when advertisers control publishers. How can you get an honest review?
